CSSF updates FAQ on CBDF
On 14 July 2024, the CSSF introduced updates to its FAQ related to cross border distribution of funds notifications (the “FAQ”). These updates include changes to both the UCITS and AIFM notifications sections.
In the UCITS notification part, the FAQ related to the required attestations was updated. Entities are no longer required to request or add CSSF UCITS attestations to their notification packages. Instead, these attestations will now be generated and added directly by the CSSF. Additionally, the question on file naming conventions for visa-stamped prospectuses was modified. When submitting alternative versions of the prospectus, such as translations or versions with country-specific supplements, applicants must now use the “DOCREP” prefix instead of “DOCFDB”. This change is essential to avoid automated rejection, as the DOCFDB prefix is reserved for documents containing the CSSF's electronic signature.
In the AIFM notification part, a new question was added regarding the required attestations. Like the UCITS updates, the CSSF AIFM attestations no longer need to be requested or manually added by entities, as they will be automatically generated and included by the CSSF in the notification packages.
Additionally, the question related to the procedure for pre-marketing notifications in the AIFM notification part has been deleted.
