Crypto-Asset ATMs in Luxembourg
On 27 May 2024, the CSSF issued a communication on crypto-asset ATMs.
The CSSF advises individuals interested in conducting crypto-asset transactions via ATMs in Luxembourg to verify if the providers operating these ATMs are registered as Virtual Asset Service Providers (“VASPs”) with the CSSF. This registration ensures that the provider complies with AML/CFT regulations. The list of registered VASPs can be accessed through the CSSF’s “Search Entities” application.
Any entity wishing to operate a crypto-asset ATM in Luxembourg must first register with the CSSF as a VASP. This involves an initial meeting, submission of a formal registration file, and review by the CSSF. Registration is finalised upon inclusion in the public register, with ongoing obligations to report significant changes and ensure compliance. Non-compliance can result in removal from the register and sanctions. Registration focuses on AML/CFT compliance rather than service quality endorsement.
